- Benefits consumers
- Is fair across the food industry
- Ensures businesses can continue to trade
- Is affordable for all businesses
- Safeguards jobs
- Promotes job creation
- Aids economic recovery (as opposed to crushing it)
- Is beneficial to the treasury (Mr Chancellor - a lower percentage of something large is greater than 20% of nothing)
The Issue
Put simply, the law requires that a product sold at a temperature above the ambient temperature is subject to VAT.
The problem is that ambient temperature is not defined but is variable and varies widely especially from winter to summer. Hot products cool gradually and the only way to know if a product is above the ambient temperature, and therefore subject to VAT, is to measure the temperature of the product, measure the temperature of the air, compare the two temperatures and apply VAT or not. Also, in winter, when ambient temperatures are lower, would you consider a product served just above 18C to be hot?
